公司註冊處要求「晨光萬事屋」解釋「黃色經濟圈」、「手足」等公開言論 律師質疑「特別審查」

法政匯思發言人、大律師何旳匡認為,公司註冊處若對公司成立的原因有所懷疑,例如違反《公司條例》第67(2)條「公司只可為合法目的而組成」,可以去信要求申請人解釋。他表示,處方或會以申請人網上的言論作審視公司成立是否合法的證據,處方的做法在權力上並無不妥、合乎程序公義。 不過,何旳匡質疑,公司註冊處的做法有如「特別審查」,不明白為何處方故意挑選晨光萬事屋、引述其公開言論作背景審查,「其實公司註冊處會唔會因為政治原因,已經成立咗資料庫去儲存申請人嘅資料呢?(指公開言論)」他認為,事件或涉及公眾利益,公眾有知情權了解處方收集市民個人資料、包括市民網上公開言論的原因。 至於處方提及《公司條例》第100條,何旳匡質疑是不適當引用條文。他指,晨光萬事屋的公司名稱,表面上沒有問題,亦沒有使用具誤導成份的用字。
